I received my Juris Doctor degree from the University of Cincinnati College of Law, and I have also received a Master of Laws in Taxation degree from Capital University Law School. I am married and have two children, one of whom is a twenty-one year old son who suffers from autism, a neurological disorder which affects a growing number of Americans. The vast majority of individuals who have autism will never be able to live independently nor support themselves financially. It is because of my son that I have become involved as an attorney drafting disability trusts, supplemental services trusts, special needs trusts, and Medicaid trusts.
The drafting of disability trusts is a matter which not all trust or estate planners truly understand how to do. It requires a knowledge of the laws of the particular state where the trust is drafted, a knowledge of the regulations of the state's Medicaid program to ensure that the trust will not be counted as an available financial resource of support for the disabled individual, and a knowledge of the social security regulations and the Program Operations Manual System (POMS) which guides social security employees in similarly determining whether the trust's assets are an available financial resource for social security benefits such as Supplemental Security Income (SSI). These guide the drafter of the trust to ensure that inappropriate wording, the kind regularly found in "garden-variety" trusts, does not creep into the document by accident or lack of experience.
